IMPORTANT: PLEASE READ THESE OFFICIAL RULES, WHICH ARE A CONTRACT, CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES. BY PARTICIPATING, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES.
SPONSOR: PLAYA’S ULTIMATE ANNIVERSARY SWEEPSTAKES (“Sweepstakes”) is sponsored by Playa Management USA, LLC, 1560 Sawgrass Corporate Parkway, Suite 140, Fort Lauderdale, FL 33323 (“Sponsor”).
ELIGIBILITY: Sweepstakes is open only to individuals who are legal residents of any one (1) of the fifty (50) United States, the District of Columbia, or Puerto Rico who are at least the age of majority in their state of residence on the opening date of the Entry Period. Employees, officers, directors, members, managers, agents, and representatives of Sponsor or its parent and subsidiary companies, affiliates, divisions, franchisees, franchisors; representatives, consultants, sub-contractors, suppliers, distributors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies (collectively the “Released Parties”) and members of their immediate families (spouse, partner, parents, legal guardians, in-law, grandparent, children, siblings, and grandchildren, and each of their respective spouses) and individuals living in the same household (whether related or not) as such individuals, are not eligible.
ENTRY PERIOD: The Entry Period opens at 8:00:00 a.m. Eastern Time (“ET”) on July 21, 2023 and ends at 11:59:59 p.m. ET on August 25, 2023.
TO ENTER: Eligible individuals may enter the Sweepstakes one (1) time during the Entry Period by visiting https://www.playaresorts.com/10-years-of-playa (“Sweepstakes Site”) and following the on-screen links and instructions to complete the required name, email address and phone number, agree to these Official Rules, and submit the Sweepstakes entry form. By entering, entrants represent and warrant that their entry (and each element thereof) complies with these Official Rules. An entry is earned when Sponsor records receipt of a completed entry with all required information. Entries will be accepted or determined ineligible by Sponsor in its sole discretion. Limit one (1) entry per person, regardless of email address. All entries submitted become the sole property of Sponsor and will not be returned. Sponsor’s clock is the official timekeeper for this Sweepstakes. Those who do not provide the correct information in their entry or abide by these Official Rules and other instructions of Sponsor and its representatives may be disqualified and all associated entries void. Purported entries that are forged, altered, incomplete, late, lost, inaccurate, misdirected, mutilated, illegitimate, incomprehensible, or garbled, including without limitation by human error, or generated by a macro, bot, or other automated means are invalid. Entries or participation on behalf of any entrant by any other individual, entity or group, or web site or online service, including, without limitation, through commercial promotion subscription notification or entering services, are invalid.
PRIVACY: As a condition of entering the Sweepstakes, each entrant consents to receive communications from Sponsor and its agents for the purpose of administering this Sweepstakes. When providing your email address, you may opt in to receive marketing emails from Sponsor, however you may unsubscribe at any time by following the “unsubscribe” link and instructions in any email, and doing so will not affect your entry into the Sweepstakes. Except as provided herein, personal information collected in connection with this Sweepstakes is governed by Sponsor's privacy policy at http://www.playaresorts.com/privacy-policy.
Except where prohibited by law, winner grants the Released Parties the irrevocable, sublicensable, perpetual right and permission to use, publish, post or display winner’s name, photograph, likeness, voice, prize information, biographical information, any quotes attributable to winner, if true, and any information or content provided in the entry (together, "Likeness") (which may be altered, used alone, or used with other material) for advertising, trade, promotional and publicity purposes without further obligation or compensation of any kind, in any medium now known or hereafter discovered or devised, world-wide, and without notice, review, or approval. Winner releases all Released Parties from any and all liability related to such use of the Likeness. Nothing contained in these Official Rules obligates Sponsor and/or the Released Parties to use any Likeness and winner waives any right to inspect or approve any such use.
WINNER SELECTION/NOTIFICATION: Five (5) potential winners will be selected in a random drawing held on or about five (5) business days after the end of the Entry Period from among all eligible entries received. Within approximately five (5) business days after the drawing, Sponsor or its designee will attempt to notify the potential winner by email. If any prize, prize notification, or Sweepstakes-related communication is rejected, faulty, or undeliverable; if the potential winner does not respond according to the notification’s or Sponsor’s instructions; or if potential winner fails to comply with these Official Rules, the prize may be forfeited and an alternate potential winner selected as provided herein. As a condition of being awarded the prize, potential winner may be required to complete, sign, notarize (if applicable), and return an affidavit or declaration of eligibility and liability/publicity release and an IRS Form W-9 to Sponsor within five (5) business days from the date on Sponsor's communication sending the documents. Any failure to timely return the signed and notarized (if applicable) affidavit may result in prize forfeiture and an alternate potential winner will be selected as provided herein. If a confirmed winner is unable or fails to use the prize or portion thereof, no compensation will be given and Sponsor will have no responsibility or liability to winner. Decisions of Sponsor are final and binding on all matters relating to the Sweepstakes.
PRIZE DELIVERY: Prize or prize elements will be emailed or mailed, where applicable, to winner’s email or postal address as provided to Sponsor in winner confirmation.
PRIZE, ODDS & APPROXIMATE RETAIL VALUE (“ARV”): Five (5) prizes will be awarded in accordance with these Official Rules, consisting of the following prizes:
Day 1: one (1) voucher for a three (3) day / three (3) night stay for winner and one (1) guest in one (1) standard category room at Jewel Paradise Cove, double occupancy, under the standard all-inclusive package (including meals, alcoholic and non-alcoholic beverages, daily resort activities) and terms (ARV $ 1,000);
Day 2: one (1) voucher for a three (3) day / three (3) night stay for winner and one (1) guest in one (1) standard category room at Seadust Cancun Family Resort, double occupancy, under the standard all-inclusive package (including meals, alcoholic and non-alcoholic beverages, daily resort activities) and terms (ARV $ 900);
Day 3: one (1) voucher for a three (3) day / three (3) night stay for winner and one (1) guest in one (1) standard category room at Wyndham Alltra Playa del Carmen, double occupancy, under the standard all-inclusive package (including meals, alcoholic and non-alcoholic beverages, daily resort activities) and terms (ARV $ 700);
Day 4: one (1) voucher for a three (3) day / three (3) night stay for winner and one (1) guest in one (1) standard category room at Hyatt Ziva Riviera Cancun, double occupancy, under the standard all-inclusive package (including meals, alcoholic and non-alcoholic beverages, daily resort activities) and terms (ARV $ 900);
Day 5: one (1) voucher for a three (3) day / three (3) night stay for winner and one (1) guest in one (1) standard category room at Hilton La Romana Family Resort, double occupancy, under the standard all-inclusive package (including meals, alcoholic and non-alcoholic beverages, daily resort activities) and terms (ARV $ 1,000).
Total ARV All Prizes $4,500. Odds of winning depend on the number of eligible entries received Reservations must be made through Sponsor. Prize voucher for Day 1 is redeemable only at Jewel Paradise Cove. Prize voucher for Day 2 is redeemable only at Seadust Cancun Family Resort. Prize voucher for Day 3 is redeemable only at Wyndham Alltra Playa del Carmen. Prize voucher for Day 4 is redeemable only at Hyatt Ziva Riviera Cancun. Prize voucher for Day 5 is redeemable only at Hilton La Romana Family Resort. Each Prize voucher must be redeemed and travel must be completed no later than August 31, 2024. Each Prize does not include airfare, ground transportation, transfers, incidental costs, excursions, or spa services. ARV of Prizes for Day 1, Day 2, Day 3, Day 4 and/or Day 5 may vary depending on dates of travel, type of room available and whether adult or child guest accompanies winner. Redemption is subject to availability and may be subject to blackout dates. All taxes (federal, state, and local) based on income to winner, as well as any expenses, costs or charges of any kind not specified in these Official Rules as being provided as part of the prize, are the sole responsibility of winner. IRS Form 1099-MISC may be issued. Released Parties are not responsible for and winner will not receive the difference between the actual value of the prize at the time of redemption and the stated ARV in these Official Rules or in any promotion-related materials.
Sponsor is not responsible for and will not replace any lost, mutilated, or stolen prize. If winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited. Winner is strictly prohibited from selling, auctioning, trading or otherwise transferring any part of the prize. No prize substitutions or cash redemptions will be made, however, Sponsor reserves the right to substitute the stated prize or portion thereof with another prize or portion thereof of equal or greater value. No more than the prizes as stated will be awarded. Winners waive the right to assert, as a cost of winning the prize or on any other basis, that Sponsor owes or must pay any costs of verification, redemption or travel to claim the prize and any liability and publicity which might arise. Sponsor is not liable for any missed prize events, opportunities or expenses incurred as a consequence of transportation cancellation/delay. Winner may be required to provide a credit card at time of hotel check-in to cover hotel incidentals.
GUEST: Winner’s guest (if any) must be the age of majority in the guest’s jurisdiction of primary residence, unless winner is the guest’s parent or legal guardian. Winner agrees that the guest (if any) must complete, sign and return a release of liability and, where legal, a publicity release, to Sponsor in the timeframe specified by Sponsor. Once selected by winner, guest (if any) cannot be changed without the express written consent of Sponsor in its discretion. Winner agrees to maintain winner’s behavior and the behavior of the guest in accordance with all applicable laws and generally accepted social practices in connection with participation in any prize-related activity. Winner agrees that Sponsor has the right to disqualify and remove, without compensation, winner and/or guest (if any) from any activity at any time if winner’s or guest’s behavior is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of Sponsor.
LIMITATION OF LIABILITY: EACH ENTRANT AGREES TO RELEASE, DISCHARGE, HOLD HARMLESS AND INDEMNIFY EACH OF THE RELEASED PARTIES AND META PLATFORMS, INC. FROM AND AGAINST ANY CLAIMS, DAMAGES, DISABILITY, ATTORNEYS' FEES, AND COSTS OF LITIGATION AND SETTLEMENT, AS WELL AS ANY LIABILITY WHATSOEVER FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH PARTICIPATING IN THIS SWEEPSTAKES OR THE USE, ACCEPTANCE, POSSESSION, MISUSE OR AWARDING OF THE PRIZE, WHILE PREPARING FOR, PARTICIPATING IN AND/OR TRAVELING TO OR FROM ANY PRIZE-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY. WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WINNER AGREES THAT THE RELEASED PARTIES AND META PLATFORMS, INC. ARE NOT RESPONSIBLE IN ANY WAY FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR RE-ROUTING. WINNER ACKNOWLEDGES THAT WINNER IS SOLELY RESPONSIBLE FOR ANY ACTIONS, CLAIMS, OR LIABILITIES OF THE GUEST (IF ANY) RELATED TO ANY SWEEPSTAKES-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY ACTIONS, CLAIMS OR LIABILITIES RELATED TO GUEST’S USE OF ANY PORTION OF THE PRIZE.
ADDITIONAL DISCLAIMERS: The prizes will be awarded to the holder of the email address used in the corresponding entry. In the event of a dispute as to the identity of an entrant, entry will be deemed made by the registered email account holder of the email address used at the time of entry, but only if that person otherwise meets the eligibility criteria in these Official Rules.
Released Parties are not responsible and/or liable for any errors, problems or configuration of or relating to any Sweepstakes-related correspondence or materials which may limit a person’s ability to participate in this Sweepstakes or receive communication from Sponsor. Released Parties are not responsible for any communications that are undeliverable or do not reach entrant as a result of any form of filtering or insufficient space in entrant’s email account.
Released Parties are not responsible or liable to any entrant or winner or any person claiming through such entrant or winner for failure to supply the prize or any part thereof in the event that any of the Sweepstakes activities or Released Parties’ operations or activities are affected by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, pandemic, quarantine, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, order or other action adopted or taken by any governmental, federal, state or local government authority, or any other cause, whether or not specifically mentioned above.
All entrants, as a condition of entry, agree to be bound by these Official Rules and the decisions of Sponsor. Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right to restrict or void entries or participation from any IP address or other source if any suspicious entry and/or participation is detected. Sponsor reserves the right to void entries of any entrants who Sponsor believes have attempted to tamper with or impair the administration, security, fairness, or proper play of this Sweepstakes. If Sponsor determines, at any time and in its sole discretion, that an entrant, potential winner or winner is ineligible, in violation of these Official Rules, or engaging in behavior that Sponsor deems inappropriate or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to take appropriate action in its sole discretion and will have no responsibility or liability to that entrant, potential winner or winner, even if the potential winner may have been notified or the winner announced.
GENERAL TERMS: Sponsor’s failure to or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. In the event there is an alleged or actual ambiguity, discrepancy, or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and/or these Official Rules (including any alleged discrepancy or inconsistency within these Official Rules), it will be resolved by Sponsor in its sole discretion. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. If the Sweepstakes is not capable of running as planned for any reason, Sponsor reserves the right to cancel, modify or suspend the Sweepstakes and award the prize from eligible entries received prior to cancellation, modification, or suspension or as otherwise deemed fair and appropriate by Sponsor. If any person supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain the prize, Sponsor may disqualify that person and seek damages from him or her and that person may be prosecuted to the full extent of the law.
DISPUTES/GOVERNING LAW: Except where prohibited, as a condition of participating in this Sweepstakes, each entrant agrees that all disputes that cannot be resolved between the entrant and any Released Party, claims and causes of action arising out of or in connection with this Sweepstakes, or the prize awarded, or the determination of winner must be resolved individually, without resort to any form of class action. Under no circumstances will any person be permitted or entitled to obtain awards for punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than actual out-of-pocket expenses (if any), not to exceed ten U.S. dollars ($10 USD), and entrant further waives all rights to have damages multiplied or increased.
This Sweepstakes and any dispute arising under or related thereto (whether for breach of contract, tortious conduct, or otherwise) will be governed by the laws of the State of Florida, without reference to its conflicts of law principles. Any legal actions, suits or proceedings related to this Sweepstakes will be brought exclusively in the state or federal courts located in Miami, Florida, and each entrant accepts and submits to the personal jurisdiction of these Florida courts with respect to any legal actions, suits or proceedings arising out of or related to this Sweepstakes.
WINNER’S LIST/OFFICIAL RULES: A copy of these Official Rules and winner's list are available by sending a self-addressed, stamped envelope with sufficient return postage indicating “Official Rules” and/or “Who Won?” to PLAYA’S ULTIMATE ANNIVERSARY SWEEPSTAKES, c/o Playa Management USA, LLC, 1560 Sawgrass Corporate Parkway, Suite 140, Fort Lauderdale, FL 33323. Requests must be received no later than three (3) months after the close of the Entry Period. Vermont residents may omit return postage for Official Rules requests.
